VORTEX AI – Terms of Service
Welcome to Vortex AI. These Terms of Service ("Terms") govern your access to and use of the Vortex-1 model, our API, and the creative generation tools (Image and Video) provided by Vortex AI ("Service"). By using our Service, you agree to be bound by these Terms.
1. The Service (Vortex-1)
Vortex AI provides access to Vortex-1, a high-performance LLM with native vision and integrated creative generation capabilities.
Sovereignty
Vortex-1 is a proprietary model environment owned and operated by Vortex AI.
Modular tools
Image and video generation are provided as integrated tools within the Vortex ecosystem.
2. Ownership & intellectual property
Your content
You retain all ownership rights to the prompts you submit to the Service.
Vortex output
Vortex AI hereby assigns to you all its right, title, and interest in and to the output generated by the Service (Images, Videos, and Text) based on your prompts, provided you comply with these Terms.
Our technology
Vortex AI retains all rights to the underlying model architecture, "Vortex-1" branding, API structures, and specialized training weights.
3. Usage limits & API access
Direct keys
API keys issued directly by Vortex AI are for the sole use of the registered account holder.
OpenRouter access
Use of Vortex-1 via OpenRouter is subject to both OpenRouter’s terms and these supplemental Vortex AI terms.
Restrictions
You may not use the Service to:
- Reverse engineer the Vortex-1 model.
- Use outputs to train competing "base models."
- Circumvent the credit/token system or "top-up" requirements.
4. Fees and payments
Credit system
Access to image and video generation is metered via Vortex Credits.
Top-ups
Users may purchase additional credits to extend usage beyond the standard tier.
Refunds
Due to the high compute costs associated with GPU inference, all credit purchases are final and non-refundable.
5. Data privacy & security
Vortex AI does not use your private prompts or generated creative content to train "public" versions of the model without your explicit consent. Your data is your business.
6. Limitation of liability
Vortex AI provides the Service "as is." While Vortex-1 is designed for ultra-realism, we do not guarantee the accuracy of information provided by the LLM or the "perfect" rendering of every creative prompt. To the fullest extent permitted by applicable law, Vortex AI and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service.
7. Acceptable use
You agree not to use the Service to violate any law or regulation, to infringe anyone else’s intellectual property or other rights, or to develop, promote, or distribute malware, spam, or other harmful or deceptive materials. You may not use the Service to generate or distribute content that exploits or harms minors, organizes abuse or violence, or violates applicable platform or carrier rules. You may not probe, scan, or test the vulnerability of our systems except with our prior written consent. We may investigate and cooperate with law enforcement regarding suspected violations.
8. Termination and suspension
You may stop using the Service at any time. We may suspend or terminate access to the Service if we reasonably believe you have violated these Terms, created risk or possible legal exposure for us or others, or if we discontinue the Service. Upon termination, your right to use the Service ends; provisions that by their nature should survive (including ownership, restrictions, fees paid, limitation of liability, and this Section 8) will survive.
9. Changes to these Terms
We may modify these Terms from time to time. When we do, we will update the "Last updated" date above and post the revised Terms to this page. For material changes, we may also provide notice through the Service or by email where appropriate. Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the revision.
10. General
Operating company
The Service is offered by VORTEX AI, a brand operated by EactiveNet, Inc. ("EactiveNet"). References in these Terms to "Vortex AI," "we," or "us" include EactiveNet and its affiliates involved in providing the Service, as applicable.
Entire agreement; precedence
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede prior oral or written understandings on that subject. If you have entered a separate written agreement with us that expressly governs the Service (for example, an enterprise order form), that agreement controls to the extent of any conflict with these Terms.
